Please read these Terms carefully before using the Platform.

1. About These Terms

These Terms & Conditions ("Terms") govern your access to and use of the mobile applications, website at www.motostream.app, and related services (together, the "Platform") operated by MotoStream Rent a Car L.L.C ("MotoStream", "we", "us", or "our"), a company headquartered in Dubai, United Arab Emirates (Commercial Licence No. 1545916), operating a peer-to-peer car-sharing marketplace serving users in Morocco.

By creating an account or otherwise accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

Definitions:

"Sahbi" — a vehicle owner who lists one or more vehicles for rent on the Platform.
"Renter" — a user who books and rents a vehicle through the Platform.
"Booking" — a confirmed reservation of a vehicle made through the Platform.
"AI CarScan" — MotoStream's tool that documents a vehicle's condition before and after a rental.
"User", "you" — any Sahbi, Renter, or other person who uses the Platform.

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. We may publish supplemental terms, guidelines, or policies for certain features or promotions; where they conflict with these Terms for that feature, the supplemental terms prevail.

We may amend these Terms from time to time. Changes take effect when we post the updated Terms on the Platform. Your continued use after that constitutes acceptance of the amended Terms.

2. Our Role — MotoStream Is a Marketplace

MotoStream provides a technology marketplace that connects a Sahbi with a Renter. MotoStream is not the owner of any vehicle listed on the Platform, is not a car rental company, and is not a party to the rental arrangement between a Sahbi and a Renter.

When a Booking is confirmed, the rental arrangement is directly between the Sahbi and the Renter. Each Sahbi is an independent provider responsible for their own vehicle. MotoStream's role is limited to operating the Platform and the tools and support described in these Terms.

MotoStream provides technology only and is not responsible or liable for the vehicles listed on the Platform. The condition, safety, roadworthiness, legality, insurance, registration, maintenance, and use of any vehicle are the sole responsibility of the Sahbi and the Renter.

MotoStream does not own, operate, inspect, control, endorse, or guarantee any vehicle, and is not responsible or liable for any act, omission, damage, loss, injury, accident, or dispute arising from a vehicle or from the conduct of any Sahbi or Renter. Any claim relating to a vehicle or a rental must be resolved between the Sahbi and the Renter (and their insurer), not against MotoStream.

Licence to use the Platform. Subject to these Terms, MotoStream grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial use. You may not: copy, modify, reverse-engineer, or create derivative works of the Platform; scrape or data-mine it; remove proprietary notices; resell or commercially exploit it; or attempt to gain unauthorised access to it or its systems.

Ownership. The Platform, and all intellectual property rights in it, remain the property of MotoStream and its licensors. These Terms do not grant you any right to use MotoStream's name, logos, or trademarks.

3. Eligibility and Accounts

To use the Platform, you must be at least 18 years old and able to enter into a legally binding contract.

You must register for and maintain an account with accurate, complete, and current information. Renters must hold a valid driving licence. As part of registration and verification, you may be required to submit identity documents and complete identity checks.

You are responsible for all activity under your account and for keeping your login credentials confidential. Notify us immediately if you suspect unauthorized use of your account. We may suspend or terminate your account if you breach these Terms, provide false information, or use the Platform unlawfully.

4. Renter Responsibilities

As a Renter, you agree to:

Hold a valid driving licence and provide proof of identity where requested;
Complete the AI CarScan at both pickup and return;
Use the vehicle lawfully, safely, and only for its intended purpose, and not for any illegal activity;
Return the vehicle on time and in the condition you received it, subject to normal wear and tear;
Follow the fuel, mileage, and usage terms shown in the listing;
Not allow any unauthorised person to drive the vehicle;
Promptly report any accident, damage, theft, or mechanical issue; and
Be responsible for any fines, tolls, or traffic violations incurred during your rental period.

You are responsible for the cost of repairing damage to, or cleaning of, the vehicle beyond normal wear and tear resulting from your rental, as documented by the AI CarScan.

5. Sahbi Responsibilities

As a Sahbi, you agree to:

Have the legal right to list and rent out the vehicle, including all required registrations, insurance, and authorisations under applicable law;
Ensure the vehicle is roadworthy, safe, clean, and accurately described in your listing;
Keep your availability, pricing, and vehicle information up to date;
Honour confirmed Bookings and hand over the vehicle as agreed;
Complete the AI CarScan at both pickup and return; and
Comply with all applicable laws relating to renting out your vehicle.

You are responsible for the legality, condition, and roadworthiness of your vehicle. MotoStream does not inspect, endorse, or guarantee any vehicle listed on the Platform.

6. Bookings, Cancellations, and Rental Period

A Booking is confirmed when accepted through the Platform, and creates a binding arrangement between the Sahbi and the Renter.

Cancellation, no-show, and late-return terms — including any applicable fees — are shown at the time of Booking. The rental period, and any extension, must be agreed through the Platform; late returns may incur additional charges.

7. Payments, Fees, and Payouts

Charges. The Renter pays the rental charges shown at Booking, inclusive of applicable taxes.
Payment facilitation. MotoStream facilitates the Renter's payment to the Sahbi as the Sahbi's limited payment collection agent. Payment made in this way is treated as payment made directly to the Sahbi. Payments are processed by our third-party payment provider; MotoStream does not store full card details.
Service fee. MotoStream retains a service fee (commission) for use of the Platform, as disclosed to Users. The remaining amount is paid out to the Sahbi in accordance with our payout process.
Pre-authorisation. We may place a temporary hold on your payment method to confirm sufficient funds. Any amount not applied to charges is released.
Insurance add-ons. Renters may be offered optional excess-insurance coverage that removes the need for a large upfront deposit. The scope of coverage, exclusions, and any excess are set out in the applicable insurance terms.
Damage and cleaning fees. Where the AI CarScan and our review confirm damage or cleaning beyond normal wear and tear, MotoStream may facilitate a charge to the Renter's payment method for the reasonable cost, payable to the Sahbi.
Refunds. Charges are non-refundable unless required by law or otherwise determined by MotoStream.

8. AI CarScan

AI CarScan is a mandatory part of every rental. Both the Sahbi and the Renter must complete the scan at pickup and at return. The resulting record is the primary evidence of the vehicle's condition and is used to resolve disputes and support insurance claims. By using the Platform, you agree to complete AI CarScan honestly and accept the record it produces as evidence of vehicle condition, subject to your right to raise a dispute.

9. Insurance and Disputes

Insurance coverage may be provided through MotoStream's insurance partners or through optional add-ons selected at Booking. Coverage, exclusions, excess amounts, and claims procedures are governed by the applicable insurance terms. In the event of a dispute between a Sahbi and a Renter (including any accident or damage claim), MotoStream may review the AI CarScan record and other information and may share relevant information with an insurer or claims processor to help resolve the matter.

10. Prohibited Conduct

You agree not to:

Arrange or complete rentals outside the Platform to avoid fees;
Provide false, misleading, or fraudulent information;
Use the Platform or any vehicle for any unlawful purpose;
Misuse, damage, or endanger any vehicle or person;
Harass, threaten, or defraud another User; or
Interfere with, disrupt, or attempt to gain unauthorised access to the Platform.

Breach of this section may result in immediate suspension or termination and, where appropriate, referral to the authorities.

11. User Content

You may submit content such as reviews, ratings, photos, and messages ("User Content"). You retain ownership of your User Content but grant MotoStream a worldwide, royalty-free, transferable, sub-licensable licence to use, host, store, reproduce, and display it in connection with operating and promoting the Platform. You represent that you own or have the rights to your User Content and that it does not infringe the rights of any third party or violate any law.

12. Disclaimers

The Platform is provided "as is" and "as available." To the maximum extent permitted by law, MotoStream disclaims all warranties not expressly set out in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. MotoStream does not guarantee the quality, safety, legality, or roadworthiness of any vehicle, or the conduct or reliability of any Sahbi or Renter, and does not guarantee that the Platform will be uninterrupted or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, MotoStream shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, personal injury, or property damage, arising out of or in connection with your use of the Platform or any rental arranged through it — including any transaction or dispute between a Sahbi and a Renter. MotoStream's total aggregate liability to you in connection with the Platform shall not exceed the total service fees you paid to MotoStream in the six (6) months preceding the event giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law, or affects mandatory consumer-protection rights available to you.

14. Indemnity

You agree to indemnify and hold harmless MotoStream and its officers, directors, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with: your use of the Platform; your breach of these Terms; your User Content; or your violation of any law or the rights of any third party, including another User.

15. Term and Termination

These Terms apply for as long as you use the Platform. You may stop using the Platform and close your account at any time. We may suspend or terminate your access at any time for breach of these Terms or where required by law. Provisions that by their nature should survive termination — including sections on payments owed, disclaimers, limitation of liability, indemnity, and governing law — will survive.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-law principles, and subject to any mandatory consumer-protection laws that apply to Users in Morocco. The parties will first attempt to resolve any dispute amicably. Failing that, the dispute will be subject to the exclusive jurisdiction of the competent courts of Dubai, without prejudice to any mandatory right you may have to bring proceedings before, or benefit from the protection of, the courts or authorities of your place of residence.

17. General

Notices. We may give notice through the Platform, by email to your account address, or by another reasonable means. You may contact us at the details below.
Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or successor.
Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in effect.
Entire agreement. These Terms, together with the Privacy Policy and any supplemental terms, constitute the entire agreement between you and MotoStream regarding the Platform.
No partnership. No joint venture, partnership, employment, or agency relationship is created between you, MotoStream, or any other User by these Terms, except that MotoStream acts as the Sahbi's limited payment collection agent as described in Section 7.
Force majeure. MotoStream is not liable for any failure or delay caused by events beyond its reasonable control.

1. Introduction

This Privacy Policy explains how MotoStream Rent a Car L.L.C ("MotoStream", "we", "us", or "our") collects, uses, shares, and protects your personal data when you access or use the MotoStream mobile applications, our website at www.motostream.app, and related services (together, the "Platform").

MotoStream is headquartered in Dubai, United Arab Emirates, and operates a peer-to-peer car-sharing marketplace serving users in Morocco.

Our role. MotoStream is a marketplace intermediary. We connect vehicle owners — referred to on the Platform as "Sahbi" — with people who wish to rent those vehicles ("Renters"). MotoStream does not own the vehicles listed on the Platform and is not a car rental company. We provide the technology, verification tools, and support that allow a Sahbi and a Renter to transact with each other.

By accessing or using the Platform, you confirm that you have read and understood this Privacy Policy.

2. Scope and Application

This Policy applies to everyone who uses the Platform — whether you are a Sahbi, a Renter, a visitor to our website, or someone who contacts us — and to all personal data we collect through our apps, our website, and our support channels.

Throughout this Policy:

"Personal data" means any information that relates to an identified or identifiable individual.
"Processing" means any operation performed on personal data, including collecting, storing, using, sharing, and deleting it.
"Sahbi" means a vehicle owner who lists one or more vehicles on the Platform.
"Renter" means a user who books and rents a vehicle through the Platform.

This Policy is made available in English, French, and Arabic (Darija). If there is any inconsistency between versions, the English version prevails.

3. Legal Framework and Legal Basis

As a Dubai-headquartered company operating a platform used in Morocco, we handle personal data in line with:

United Arab Emirates — Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the UAE PDPL);
Morocco — Law No. 09-08 on the Protection of Individuals with Regard to the Processing of Personal Data ("Law 09-08"), together with the requirements of the Commission Nationale de Contrôle de la Protection des Données à Caractère Personnel ("CNDP"), for personal data processed in connection with our operations in Morocco; and
General Data Protection Regulation (GDPR) principles, applied as a matter of best practice, as visitors and tourists from the European Union may access the Platform.

We rely on one or more of the following legal bases when we process your personal data:

Performance of a contract — to provide the Platform and the services you request (for example, creating your account or facilitating a booking).
Consent — where we ask for it (for example, marketing messages or access to your device location). You may withdraw consent at any time.
Legal obligation — to comply with laws that apply to us, including verification, tax, and record-keeping obligations.
Legitimate interests — to run a safe, secure, and trustworthy marketplace, prevent fraud, and improve the Platform, provided these interests are not overridden by your rights.

We monitor the evolving data-protection landscape in both jurisdictions, including recent regulatory developments in Morocco, and update our practices accordingly.

4. Data We Collect

We collect the following categories of personal data.

Identity and verification data

Full name, date of birth, and nationality
Government-issued identification (national ID / CIN, passport)
Driving licence details
Profile photograph, and a verification selfie where required

Contact and account data

Email address and phone number
Account login credentials (passwords are stored in encrypted form)
Language and communication preferences

Vehicle data (Sahbi)

Vehicle make, model, year, registration details, and condition
Vehicle registration documents and insurance information
AI CarScan images and condition records
Listing availability, pricing, and location

Transaction data

Booking history and rental records
Payment details (processed and stored by our third-party payment provider; MotoStream does not store full card numbers)
Payout details for a Sahbi, and fee and commission records

Location data

The location of a listed vehicle (provided by the Sahbi)
Your approximate location, where you grant permission, to show nearby vehicles

AI CarScan data

Photographs and images of the vehicle taken before and after each rental
Associated timestamps and condition assessments

Usage and technical data

Device identifiers, app version, session information, and IP address
Log data and crash reports (used solely to maintain and improve the Platform)

Communications

Messages exchanged with our support team and, where applicable, between a Sahbi and a Renter through the Platform

5. How We Collect Your Data

We collect personal data in three ways:

Directly from you — when you register, verify your identity, list a vehicle, make a booking, complete an AI CarScan, contact support, or otherwise communicate with us. You are responsible for the accuracy of the information you provide.
Automatically — through your use of the Platform, including device and usage data, log data, and crash reports, some of which is collected using cookies and similar technologies.
From third parties — such as our identity-verification and payment providers, who confirm or supplement the information you supply, and (where applicable) insurance partners.

If you choose not to provide certain personal data — or ask us to delete it — we may be unable to provide some or all of the Platform to you.

6. How We Use Your Data

We use your personal data to:

Create and manage your account and verify your identity;
Facilitate bookings between a Sahbi and a Renter;
Process payments and issue payouts to a Sahbi;
Operate the AI CarScan documentation feature and resolve condition-related disputes;
Communicate with you about your account, bookings, and Platform updates;
Provide customer support;
Keep the Platform safe and secure, and detect, prevent, and investigate fraud, misuse, or violations of our Terms;
Improve the Platform and develop new features; and
Comply with our legal and regulatory obligations.

7. AI CarScan and Automated Processing

AI CarScan is central to how MotoStream builds trust between a Sahbi and a Renter. Before and after each rental, the Platform captures images of the vehicle and uses automated image analysis to document its condition.

The purpose is to create a clear, timestamped record that reduces disputes and supports any insurance claim.
MotoStream also uses limited automated processing to help keep the marketplace safe — for example, to flag activity that may indicate fraud or a policy breach.
These automated tools do not make final decisions that produce legal or similarly significant effects about you on their own. Where a condition assessment or a flag is contested, our team reviews the underlying record before any outcome is determined, and you may ask us to explain or reconsider the outcome.
CarScan images relate to the vehicle and its condition; where a person is incidentally captured, that data is handled in accordance with this Policy.

8. How We Share Your Data

MotoStream does not sell your personal data. We share it only as necessary to operate the Platform:

Between a Sahbi and a Renter — the limited information needed to complete a booking (for example, first name, profile photo, and vehicle handover details);
Payment providers — to process payments and payouts securely;
Identity-verification providers — to confirm identity and driving eligibility;
Service providers — hosting, cloud infrastructure, push-notification and crash-reporting providers, and other vendors who process data on our behalf under confidentiality obligations;
Insurance partners — where relevant to coverage or a claim;
Professional advisers — such as lawyers and accountants, where necessary; and
Authorities and legal bodies — where required by law, court order, or to protect the rights, safety, and property of MotoStream, our users, or the public, or in connection with a merger, acquisition, or restructuring.

9. International Data Transfers

MotoStream is headquartered in the UAE and uses cloud infrastructure and service providers that may be located outside Morocco and the UAE. Where we transfer personal data across borders, we take steps to ensure it remains protected — including transferring to countries recognised as providing an adequate level of protection or putting appropriate safeguards in place. Where a transfer of personal data outside Morocco requires authorisation from the CNDP, we obtain that authorisation before the transfer takes place.

10. Data Retention

We keep personal data only for as long as necessary for the purposes described in this Policy, including to meet legal, accounting, tax, and dispute-resolution obligations. Verification documents, booking records, and AI CarScan records are retained for the period required to support any dispute or claim and to comply with applicable law, after which they are securely deleted or anonymised. If you close your account, we may retain certain data where required by law, for safety and fraud-prevention purposes, or to resolve an outstanding matter such as an unpaid charge or open dispute.

11. Data Security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, alteration, disclosure, loss, or destruction — including encryption of credentials, access controls, and secure infrastructure. Your account is password-protected; keep your password confidential, and note that MotoStream will never ask you for it. No system is completely secure, but we work continuously to safeguard your information and will act promptly to address any incident affecting your personal data.

12. Your Rights and Choices

Device permissions. You can control app permissions such as location and notifications through your device settings. Disabling certain permissions may limit some features.
Marketing. You can opt out of marketing communications at any time using the unsubscribe link in our emails or your in-app communication preferences. We will still send you essential service messages about your account and bookings.

Data subject rights. Subject to applicable law, you have the right to:

Access the personal data we hold about you;
Rectify inaccurate or incomplete data;
Erase your data, where there is no overriding legal obligation to retain it;
Object to or restrict certain processing;
Withdraw consent at any time, where processing is based on consent; and
Data portability, where applicable.

To exercise any of these rights, contact us at privacy@motostream.app. We will respond within 30 days. We may need to verify your identity before acting on your request, and in limited cases the law may allow us to decline — in which case we will explain why.

13. Cookies and Analytics

Our website uses cookies and similar technologies to operate the site, remember your preferences, and understand how the Platform is used (including through analytics tools). You can manage cookies through your browser settings. Disabling certain cookies may affect how the website functions.

14. Children

The Platform is intended for users aged 18 and over. Renters must hold a valid driving licence. We do not knowingly collect personal data from anyone under 18. If we learn that we have done so, we will delete it.

15. Third-Party Links

The Platform may contain links to third-party websites or services not operated by MotoStream. We are not responsible for their privacy practices, and we encourage you to review their policies before providing any personal data.

16. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you through the Platform or by email and update the "Last updated" date above. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Policy.

17. Complaints

If you have concerns about how we handle your personal data, please contact us first at privacy@motostream.app so we can try to resolve the matter. You also have the right to lodge a complaint with the relevant data protection authority, including the CNDP in Morocco.
